Few gun laws in Virginia have had a more turbulent ride than the Universal Background Check (UBC) requirement for private firearm sales. If you’ve found conflicting information online about whether private sale background checks are required in Virginia — that’s because the answer has genuinely changed multiple times in the past year. This page lays out the full timeline and the current requirements.
What “Universal Background Check” Means
Under federal law, licensed firearms dealers (FFLs) must run a background check on every buyer. But federal law does not require background checks for private, person-to-person sales between residents of the same state. A “universal” background check law closes that gap at the state level by requiring private sales to be processed through a licensed dealer so a background check can be run on the buyer.
The Timeline: How We Got Here
July 1, 2020 — The original law takes effect.
As part of a package of firearms legislation, Virginia enacted a law (Va. Code § 18.2-308.2:5) requiring that private firearm sales be facilitated through a licensed dealer, with a Virginia State Police background check on the buyer. For five years, private sellers and buyers across the Commonwealth completed their sales through local FFLs like K3 Armory.
October 2025 — A Virginia court strikes down the law.
In a lawsuit brought by the Virginia Citizens Defense League, Gun Owners of America, Gun Owners Foundation, and individual Virginia gun owners, a Lynchburg Circuit Court judge ruled the law unconstitutional and issued a permanent injunction halting its enforcement statewide.
The problem the court identified: Virginia law allowed adults aged 18–20 to legally possess handguns — but the UBC law required every transfer to go through an FFL, and federal law prohibits FFLs from transferring handguns to anyone under 21. Put together, 18–20-year-old adults had no lawful way to acquire a handgun the state said they could own. The court found the law couldn’t be fixed by removing just that piece, and struck it down entirely. The Commonwealth did not appeal within the required window.
October 2025 – May 2026 — No private sale background checks.
Under the court’s injunction, the Virginia State Police could not process background checks for private sales. During this period, private party sales in Virginia lawfully proceeded without a dealer-facilitated check — a gap some called the “Lynchburg Loophole.”
April 22, 2026 — The General Assembly responds with HB 1525.
The legislature passed and Governor Spanberger signed House Bill 1525, which took a different approach to the constitutional problem: instead of carving out young adults, it raised the minimum age to purchase a handgun or assault firearm in Virginia from 18 to 21, and re-enacted the requirement that the Virginia State Police administer background checks for private sales. The bill included an emergency clause making it effective immediately.
May – June 2026 — Legal whiplash.
The Virginia State Police resumed private sale background checks in late May. The original plaintiffs immediately challenged the move, arguing the court’s injunction was still in force. On June 3, 2026, the judge agreed his injunction remained in effect and ordered VSP to stop the checks again while he considered the Commonwealth’s motion to dissolve the injunction.
June 24, 2026 — The injunction is dissolved.
After briefing from both sides, the court granted the Commonwealth’s motion to dissolve the October 2025 injunction, clearing the way for the reinstated law to be enforced.
July 1, 2026 — Background checks resume.
Private sale background checks are once again required — and available — in Virginia.
What the Law Requires Today
As of July 1, 2026, if you’re buying or selling a firearm in a private sale in Virginia:
- The sale must be facilitated through a licensed dealer, with a Virginia State Police background check on the buyer, before the buyer takes possession.
- The minimum age to purchase a handgun or assault firearm in Virginia is now 21 — this applies to dealer sales and private sales alike.

Is This the End of the Story?
Probably not. Organizations like the Virginia Citizens Defense League (VCDL) that successfully challenged the original law have said the issue isn’t over, and further appeals or new litigation are possible.
