Virginia law allows residents to give a firearm to another person as a genuine gift without a background check or the involvement of an FFL dealer — provided certain conditions are met. 2026 Law Update: What Changed (and What Didn’t)
In April 2026, Governor Spanberger signed HB 1525, reinstating Virginia’s universal background check requirement for private-party firearm sales, effective July 1, 2026. That law applies to transactions where money, goods, services, or anything else of value changes hands.
A bona fide gift is not a sale, and it is not affected by this update. If no consideration of any kind is involved — no cash, no trade, no “you can have it if you help me move” arrangements — the transfer isn’t a “sale” under Virginia code, and the background check requirement doesn’t apply. This holds whether the gift is between family members, friends, or any two private individuals who can each legally possess a firearm; the exemption is not limited to relatives.

Key Distinctions: Gifting vs. Selling
Gifting is legal without a background check. The law exempts genuine firearm gifts from Virginia’s universal background check requirement. As a rule of thumb: no exchange of money, services, or trade of any kind can be involved — otherwise, it’s considered a “sale,” not a gift.
Sales require background checks. Any transaction involving a monetary exchange or something of value in trade requires a background check, generally completed through an FFL dealer like K3 Armory.
Giver’s Responsibilities
Even though a gift doesn’t require a background check, the person giving the firearm is still legally responsible for confirming the recipient can lawfully possess it. Before gifting a firearm, you should:
- Understand the categories of people federally prohibited from possessing firearms (the same categories checked on ATF Form 4473, Section A) — these include convicted felons, individuals subject to certain protective orders, unlawful users of controlled substances, and others.
- Review Virginia State Police’s firearm purchase eligibility guidance.
- Confirm there are no additional local restrictions where the recipient lives.
If you knowingly (or with reason to know) give a firearm to someone who isn’t legally eligible to possess it, you can face civil liability and criminal charges — regardless of the fact that no background check was legally required for the transfer itself.
Recommended Best Practices
While not legally required for a gift, we strongly recommend creating a simple Bill of Sale (or “Bill of Gift”) documenting the transfer. It should include:
- Both parties’ names and contact information
- The firearm’s make, model, and caliber
- The firearm’s serial number
- $0 listed as the purchase price, to clearly document that this was a gift and not a sale
